These Terms of Use ("Website Terms") govern your access to and use of the public Prospalytics website, landing pages, demo pages, FAQs, forms, public content, graphics, marketing materials, and other non-account website features (collectively, the "Website").

The Prospalytics account area, client dashboard, reports, exports, scheduled monitoring, subscriptions, credits, support services, and paid or account-based services are governed by the Prospalytics Terms of Service. If you create an account or use the Service, the Terms of Service apply in addition to these Website Terms.

By accessing or using the Website, you agree to these Website Terms. If you do not agree, do not use the Website.

1. Website purpose

The Website provides information about Prospalytics, including market-intelligence features, social-listening workflows, pricing or plan information if shown, product descriptions, demo materials, FAQs, support links, legal pages, and related business content.

Website content is provided for general informational and marketing purposes only. It is not legal, financial, tax, investment, medical, compliance, employment, security, or other regulated professional advice. You are responsible for independently evaluating whether Prospalytics is appropriate for your needs.

2. Eligibility and U.S. focus

The Website is intended for business and professional users who are at least 18 years old. The Website and Service are U.S.-focused. You may not use the Website if you are prohibited from doing so under applicable law, sanctions, export controls, or these Website Terms.

You may not use the Prospalytics name, logos, marks, trade dress, screenshots, or branding in a way that suggests affiliation, sponsorship, endorsement, or approval without our prior written permission.

5. Demo materials and sample outputs

The Website may include demo reports, sample charts, sample workflows, example insights, screenshots, illustrative outputs, mock data, and marketing descriptions. Demo materials are examples only. They may not reflect current features, source availability, report formats, report quality, pricing, performance, actual customer outcomes, or the exact results a customer will receive.

Do not rely on demo materials as professional advice, verified research, legal or compliance analysis, financial analysis, medical analysis, a factual guarantee, or proof that your reports will produce the same results. Actual Service outputs may differ based on public-source availability, selected communities, prompts, timing, vendor availability, model behavior, product changes, and other factors.

Website and demo content may be AI-assisted or based on automated analysis. It may be incomplete, inaccurate, outdated, or unsuitable for your use case. You are responsible for independently evaluating whether Prospalytics is appropriate for your needs.

6. Acceptable website use

You must not use the Website to:

The current reviewed implementation does not use third-party advertising cookies, retargeting pixels, or cross-context behavioral advertising technologies. If that changes, the Privacy Policy will be updated and required choices will be provided where applicable.

To the maximum extent permitted by law, our total liability arising out of or related to the Website or these Website Terms will not exceed USD $100.

13. Indemnity

You will defend, indemnify, and hold harmless Prospalytics and its owners, officers, employees, contractors, affiliates, suppliers, and licensors from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Website, your submissions, your breach of these Website Terms, your violation of law, or your infringement or misappropriation of any rights.

16. Governing law and disputes

These Website Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. The parties consent to exclusive jurisdiction and venue in the state and federal courts located in Ohio for disputes arising out of or related to these Website Terms, unless applicable law requires another forum.

Before filing a claim, the parties will attempt in good faith to resolve the dispute informally by written notice and reasonable discussion for at least 30 days, unless emergency injunctive relief is needed.

17. Miscellaneous

These Website Terms, together with the Privacy Policy and any terms incorporated by reference, are the entire agreement between you and us regarding the Website. If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Website Terms without our prior written consent.
